1. Acceptance of TermsExpand
- • By using the Trace & Anchor services (“the Services”), you expressly agree to these Terms of Use (CGU).
- • If you do not agree, you are strictly prohibited from accessing the Services.
- • DMMF may modify these terms at any time — the latest version applies as soon as published on the official website.
2. EligibilityExpand
- • Be at least 18 years old
- • Have the legal capacity to enter into a contract
- • Comply with local applicable laws
- • Do not use the Services for illegal or fraudulent purposes
3. Use of the ServicesExpand
- • Use blockchain bridges to register proofs of existence
- • Manage and safeguard your data and private keys (Pro version)
- • Follow procedures for anchoring, timestamping, or generating certificates
- • Comply with all applicable laws and regulations related to blockchain
4. Nature of Blockchain ProofsExpand
- • Trace & Anchor allows you to generate digital fingerprints (hashes) from your documents.
- • These hashes are then recorded on a public blockchain (e.g., Verge, Bitcoin, etc.).
- • ⚠️ These records are not financial instruments or digital assets; their sole purpose is to provide proof of existence, precedence, and integrity of the original document.
5. Risks of Using Blockchain TechnologyExpand
- • Loss or mismanagement of private keys (Pro version)
- • Network malfunctions or issues with partner blockchains
- • Temporary incompatibility between certain blockchains and services
- • DMMF is not liable for data loss or failed anchoring caused by factors beyond its control
6. Document Storage and SecurityExpand
- • You upload a file (.PNG or .JPG), which is converted into a hash and anchored on the blockchain.
- • The original file is stored temporarily in a secure vault, accessible only to you.
- • The document never leaves your network (proof generated locally).
- • You remain the exclusive owner of the private key used to access your secure digital vault.
7. Intellectual PropertyExpand
All content, visuals, trademarks, and interfaces provided by Trace & Anchor are the exclusive property of Delta Multimedia France or its partners. Any reproduction, distribution, or unauthorized use is strictly prohibited.
8. IndemnificationExpand
You agree to indemnify DMMF, its representatives, and partners against any claims, damages, or expenses (including legal fees) arising from fraudulent, negligent, or non‑compliant use of Trace & Anchor services.
9. Limitation of LiabilityExpand
- • Use of third‑party blockchains
- • Loss of certificates or private keys
- • Technical incidents, interruptions, or force majeure
10. Disclaimer of WarrantyExpand
- • Services are provided “as is,” without any guarantee
- • No guarantee of continuous availability of partner blockchains or preservation of proofs if users delete/modify their files or credentials
11. ModificationsExpand
DMMF may modify these Terms of Use at any time. Continued use of Trace & Anchor constitutes full acceptance of the updated terms.
12. TerminationExpand
DMMF may suspend or terminate access to the Services if you violate these Terms or for any legitimate reason. Confidentiality, liability, and IP clauses remain valid after termination.
13. Use of Partner BlockchainsExpand
⚠️ No proprietary utility token is issued by Trace & Anchor.
A MiCA license application is being prepared for early 2027, aligned with EU regulations.
- • To ensure smooth operation, a provision in XVG tokens (or equivalent) is automatically allocated every time revenue reaches €20,000 to cover transaction fees.
14. Governing Law and JurisdictionExpand
These Terms are governed by French law. Any dispute shall fall under the exclusive jurisdiction of the Béziers Commercial Court, unless resolved amicably first.
15. Force Majeure & Technical LimitationsExpand
- • Force majeure (power outage, cyberattack, natural disaster)
- • Failures of third‑party services (blockchains, hosting, APIs)
- • User‑side errors or configuration problems
